Welcome to Hungry Harvest and our Terms of Service. These Terms are very important and will affect your legal rights when using our service. Please read carefully before ordering any of our Products or subscribing to one of our Services. Know that you agree to be bound by these terms and conditions.
1. Hungry Harvest Information
1.1 We, Hungry Harvest, operate the website HungryHarvest.net . We are an LLC registered in the State of Maryland.
1.2 We, Hungry Harvest, operate the social media handle, @HungryHarvest on Instagram, Twitter, and Facebook.
2. Your Eligibility
By submitting an order through our website, you confirm that:
2.1 You are legally able to enter binding contracts. (E.G Must be 18 years old).
2.2 You are a resident of the United States of America.
2.3 You are accessing the site from the United States of America.
3. Contract Agreement
3.1 After signing up and placing an order through our form on our Site, you will receive a confirmation email from us acknowledging that your order and sign up has been received. Please note that this only submits the order. All orders must be accepted by us and confirmed (Confirmation). Based on your delivery area, your order will be accepted and receive confirmation.
3.2 Hungry Harvest offers 1 time order, bi-weekly orders, and weekly recurring orders. By submitting a bi-weekly or weekly recurring order you are agreeing to recurring charges. Hungry Harvest will submit periodic charges (E.G. Weekly) without further authorization from you, until provided with information to do otherwise (E.G. Cancellation, vacation, or hold). These changes must occur before the Wednesday before your delivery at 11:59 p.m. (Cut off to change order). We are no longer required to change your order after the cutoff date.
3.3 There is no auto-renewal with Hungry Harvest. Customers are allowed to cancel, suspend, and resume deliveries at anytime. These changes must be done by the Wednesday before your delivery at 11:59 p.m. We do reserve the right to deny resuming or re-subscription where we have previously determined to terminate a subscription.
3.4 When choosing your submitting a recurring subscription you are agreeing to pay weekly, or bi-weekly until your account is either canceled or a vacation hold is in place (Vacation Hold)
4. Service Obtainability
4.1 Our Site’s use is intended for people living in the United States of America (Serviced Country). We do not undertake orders from people outside the United States.
5. Consumer Rights
5.1 If you are under contract as a customer, there is no termination fee and your subscription can be deactivated at any time before Wednesday 11:59 p.m. EDT the week before your next product delivery is scheduled. Please also look at our refund policy (Check Clause 7).
5.2 In order to deactivate your account or cancel your subscription, you can email Family@HungryHarvest.net informing us you would like to cancel your account. There is also an option to go into your own account and delete all orders as well.
6. Prices and Payment
6.1 Hungry Harvest offers a mixed, organic, all fruit, and all veggie harvests. All sizes and prices are quoted on our site. If there are any changes we will notify via email.
6.2 Hungry Harvest offers free delivery if you live in our delivery zones in DC, MD, and VA.
6.3 We reserve the right to change the prices of our products and delivery charges. These changes will not affect orders until we have notified all customers.
6.4 All payments for all Products and Services must be paid by debit or credit card. We accept all payments from Visa, MasterCard, and American Express. We reserve the right to suspend deliveries if the credit or debit card becomes invalid and until a valid credit or debit card is inputted. We will never share your payment information.
7. Refund Policy
7.1 If a product is not quality enough from us and refused by you:
7.1.1 For all items that are not considered of quality to you, you will take a picture of that item and send it to Family@hungryharvest.net .
7.1.2 If all or part of a Product (Harvest Box) is defective we will credit or refund you an amount equivalent to the value of the Defective Item towards a future purchase. These refunds will be processed within 7 days of your email to Family@hungryharvest.net .
7.2 Refunds will be processed to the same credit or debit card being used on the account.
7.3 If your account is deactivated with credit still in the account, that credit will be refunded to you with in 30 days of deactivation.
8. Gift Cards and Discounts
8.1 We currently offer gift cards, social media promotional discounts, friend referral discounts, and other types of vouchers. The same terms and conditions apply to new customers who receive the gift cards or other various discounts.
8.2 Gift card codes must be activated online in our online form, may only be applied once, and cannot be copied or reproduced. To use your gift card voucher you will be required to enter a unique code online in the “gift card and discount code” section upon sign up or edit of order. This unique code will be emailed to your upon purchase.
8.3 Social Media and Friend Referral discounts will be tracked by us and discounts will be applied by us.
8.4 We reserve the right to withdraw or deactivate any discount (other pre-paid for gift card) for any reason at any time.
9. Consumer Rights
9.1 If you are contracting as a consumer, you may unsubscribe or hold your delivery any time before Wednesday at 11:59 PM EDT the week before your next scheduled Hungry Harvest delivery. You will not be charged for the Product if the order is cancelled before then.
9.2 To deactivate your account, you email Family@hungryharvest.net stating that you would like to cancel your account and stop receiving deliveries. This email should include your full name and email address on the account.
10. Risk and Title
10.1 Hungry Harvest products include perishable items and to maintain integrity of the products after delivery, we recommend that you immediately refrigerate or freeze these perishable items.
11.1 We merit that any Product purchased from us through HungryHarvest.net, upon delivery will match its description. It will be of acceptable quality, and be fit for all the purposes of which the product should be. If the Products purchased from us are not of acceptable quality please see Section 7 for our Refund Policy.
12. Our Liability
12.1 If there is failure to comply on our end we will be only liable for you, at most, the purchased price of the Product.
13. Events outside of our Control
13.1 We, Hungry Harvest, will not be liable for any failure to perform, or postponement, any of our obligations under a Contract that is caused by events we cannot control (Force Majeure Event). Events that our beyond our reasonable control that include the following:
13.2 Impossibility to use proper roads and streets to deliver product.
13.3 Hurricanes, earthquakes, floods, explosions, fires, epidemics or any other natural disasters.
13.4 Strikes, riots, invasion, attack, or threat and any other industrial/threatening action that prohibits us.
13.5 Public and private telecommunication networks are down and unable to use.
14. Our Right to Change Terms and Conditions
14.1 We reserve the right to modify and alter these terms and conditions, with an announcement informing you that changes have been made to the terms and conditions.
14.2 We may alter these terms and conditions from time to time to manage the changes that occur in our business model due to changes in the market, technology, regulatory requirements, and relevant laws.
